By registering, signing up, or submitting payment (including via Zelle, website form, or any other method) for any Fussbally event, program, or session, you acknowledge that you have read, understood, and agreed to the following Terms & Conditions, which apply to all Fussbally programs, events, camps, leagues, trainings, and tournaments—past, current, or future. 1. General Consent and Liability Release I hereby give my approval for my child’s participation in all Fussbally (Rachellasse Limited LLC) activities, including trainings, games, tournaments, and camps. In exchange for acceptance of my child’s participation, I assume all risks and hazards incidental to the conduct of the activities and release, absolve, and hold harmless Rachellasse Limited LLC, its officers, directors, coaches, agents, employees, and representatives from any and all liability for injuries to my child arising out of traveling to, participating in, or returning from Fussbally activities. I understand that participation in sports involves risk, including but not limited to fractures, sprains, concussions, paralysis, or death, and that these risks are inherent to the activity. I acknowledge these risks and agree that Fussbally and its affiliates shall not be held liable except in cases of gross negligence or willful misconduct. 2. Media and Communications Consent I understand that Fussbally may take photographs or video footage during events and training sessions for publicity, educational, or marketing purposes. These images may appear on the Fussbally website, social media, printed materials, or be shared with news media outlets. I grant Fussbally full permission to use such images without compensation or additional consent. I also consent to receiving communications via text message and email from Fussbally. 3. Medical Authorization and Emergency Care As the parent or guardian of the participating child, I authorize the diagnosis and treatment by a qualified and licensed medical professional in the event of a medical emergency requiring immediate attention to prevent further harm. I grant permission for necessary medical treatment, including x-ray, medication, or surgery, when recommended by attending medical personnel. Every attempt will be made to contact me prior to treatment. If unreachable, I authorize Fussbally representatives to provide emergency first aid and facilitate treatment until I can be reached. This authorization remains valid for the duration of my child’s participation in Fussbally activities. 4. Assumption of Risk – Weather and Outdoor Conditions I understand that Fussbally sessions are conducted outdoors and may continue in varying weather conditions. Fussbally follows a strict weather safety policy: Sessions will only be paused or canceled when lightning or dangerous weather poses a direct and immediate threat to participant safety, as determined by the on-site coach. Fussbally does not cancel or delay sessions based solely on forecasts or distant lightning alerts. I may reschedule my child’s session at any time for any weather-related concern, without penalty. I voluntarily assume all risks related to participation in outdoor activities and release Fussbally from liability for injuries or damages related to weather, except in cases of gross negligence. 5. Abuse Prevention Policy Fussbally maintains a zero-tolerance policy toward abuse or misconduct of any kind. Every coach, staff member, and volunteer is thoroughly vetted, reference-checked, and background-screened annually. Staff undergo training to recognize, report, and prevent abuse, with continued education in maintaining healthy boundaries and safe communication. Fussbally fosters a transparent reporting environment. Concerns may be reported anonymously, and all reports are investigated promptly. Safety, respect, and accountability are core values in every interaction between staff, players, and families. 6. Cancellation, Refund, and Credit Policy 60 days or more before event start: 100% refund minus 3% processing fee. 60–46 days before event start: 100% refund minus 3% processing fee and $50 administrative fee. 45–31 days before event start: 80% refund minus 3% processing fee, or 100% credit toward a future event. 30–21 days before event start: 50% refund minus 3% processing fee, or 80% credit toward a future event. Less than 20 days before event start: Credit offered only in cases of medical emergency (doctor’s note required). After an event begins: No refunds or credits are available for any reason, including absences, injuries, or scheduling conflicts. Rationale: Fussbally’s costs—including field rentals, insurance, staff salaries, and event coordination—are finalized before events begin. Because our expenses are fixed, we cannot provide refunds once programs start. This ensures fair and consistent pay for our professional coaching staff and preserves program quality for all participants. 7. Attendance, Make-Ups, and Team Commitment Missed trainings may be made up anytime within the same quarter at no additional cost. Once a child is placed on a league team, attendance is expected as teammates rely on participation for scheduled games. League registrations are non-refundable once the team roster has been finalized. Fussbally offers flexible scheduling to allow families to make up sessions at other times or locations when available. 8. Weather Policy Fussbally strives to provide consistency and reliability for families. Sessions are held as scheduled unless unsafe conditions exist (lightning, heavy snow, or closed fields). Light rain, wind, or cold weather are not grounds for automatic cancellation. Parents will be notified promptly of any cancellations or rescheduling. Make-ups for weather cancellations are offered based on available space during the current quarter. 9. Code of Conduct and Safety Participants and parents are expected to uphold Fussbally’s values of respect, sportsmanship, and teamwork. Fussbally reserves the right to remove any participant or family from a program for behavior that disrupts the learning environment or endangers others, without refund. 10. Universal Acceptance Clause By registering for, attending, or submitting payment for any Fussbally event, including via Zelle, Venmo, cash, check, or other methods, you acknowledge that these Terms & Conditions apply to all Fussbally programs—past, current, and future—and that no additional signed form is required for future participation. Continued participation or payment constitutes acceptance of these terms in full, regardless of whether a new form is submitted for each event. 11. Agreement and Signature By signing or electronically submitting this form, I confirm that I: Have read, understood, and agree to all sections of the Fussbally Terms & Conditions and Consent Agreement. Accept all inherent risks associated with sports participation. Authorize emergency medical care as outlined above. Grant permission for media use of photographs or videos of my child. Understand that payment for any event signifies acceptance of these policies in their entirety.
